Juvenile Charges

Juvenile charges are committed by those people who are not matured or adult. The standard age is considered 18 years. But it is considered in some states 16 years. Such as – Connecticut, New York etc. But in Texas it is considered 17 years for juvenile charges. But children under 10 years are not measured under juvenile charges.

Restraining Orders

To protect a person from physically or sexually abused or harassed, stalked or threatened from someone, a restraining order is ordered from court. The persons availing restraining orders are called “protected persons”. And this order is applied on those persons are called “restrained person”. Restraining order is applicable is on the other “protected persons” also, such as – family members or other close persons.

What restraining orders do?

  • Stay Away Order: A restrained person must stay away from protected person at least 50 to 100 yards. It is included places also, such as – living place, working place, vehicles, children’s school and child care centre etc. He or she must stay away from the places of the protected person.

Kinds of Restraining Order:
      Restraining orders are four types. 
  • Domestic Violence Order: You can apply for domestic violence restraining order in the following situations. If you have close relationship with someone (domestic partners – married or registered, separated, divorced, used to live together or live together, have children together etc) or you are closely related someone ( child, parent, brother, sister, grandfather, grandmother, in-law etc) and he or she abused you. 
  • Dependant Abuse Order: You can apply for dependent abuse restraining order if your age is 65 or more or 18-64 and you have physical or mental disabilities that can make you vulnerable to protect own-self. And you have already suffered from abandonment, financial or physical abuse etc. 
  •  Civil Harassment Order: You can apply for civil harassment restraining order if you are being harassed, threatened, abused, stalked etc from someone who is not closely related to you. Such as – neighbors, roommates, nephews or nieces, cousins, aunts etc. 
  •  Workplace Violence Order: You can apply for workplace violence restraining order. If the following one or more or all causes are true. If you are an employer and your one or more employees harassed, stalked, made violence, threatened you. 
Advantages of restraining order:  
  • Physical: Restraining order ensures your physical safety. Because the restrained person is bounded in restricted area. He or she is restricted to carry any kind of firearm and non firearm weapon.

 Getting Restraining Order:
If you apply for restraining order, so you are called applicant and the against person is called respondent. At first you have to go any Magistrates Courts to apply. But if the respondent is under 18 years old, then you have to go to Children’s Court. According to the govt. rules you have to submit your application. And you have to show evidence of committing abuse or threaten against you or reasonable cause.
